Terms & Conditions

1. Agreement to these Terms

1.1 These Terms and Conditions ("Terms") govern your use of www.thefinancialvines.com, its tools, calculators, apps, games, study hubs, resources and AI features, our newsletters and WhatsApp, email and social-media channels, and any mutual fund distribution services we provide (together, the "Services").

1.2 By using the Services you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy, Disclaimer & Risk Disclosure and Refund Policy form part of these Terms. How we handle your personal data is explained only in the Privacy Policy, and where we need your consent we ask for it separately.

1.3 These Terms are published under the Information Technology Act, 2000 and rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules").

2. Who we are

The Services are provided by Jobsarus Online Private Limited (CIN U74999HR2022PTC100396), registered office Plot No 114, Block 5, Phase-5, Sector 53, HSIIDC, Kundli, Sonipat, Haryana 131028, India, a company incorporated in India, recognised as a startup by DPIIT, and registered with AMFI as a Mutual Fund Distributor (ARN-283063). "The Financial Vines" is its brand. "We", "us" and "our" mean Jobsarus Online Private Limited.

3. Eligibility and accounts

3.1 You must be at least 18 and able to enter a binding contract under Indian law to create an account, buy a product, use our apps that save personal data, or invest through us. Our free public content can be read by anyone.

3.2 Give accurate details when you register and keep them up to date. Keep your password and OTPs private. You are responsible for activity on your account; tell us at once at info@thefinancialvines.com if you suspect misuse.

3.3 Some tools, apps and resources open without an account, but saving data, downloading files and buying anything require you to sign in.

4. Educational content, not advice

4.1 Our calculators, apps, games, AI features, articles, videos, courses and study materials are for information and education only. They are not investment, tax, legal or financial advice, and they are not a recommendation to buy or sell any security or product.

4.2 Results from our tools and AI features are automated estimates based on the inputs and assumptions you provide. They may be incomplete or wrong. Check them independently and consult a qualified professional before making decisions.

4.3 Mutual fund investments are subject to market risks. Read all scheme-related documents carefully. Past performance does not indicate future returns. See our Disclaimer & Risk Disclosure.

5. Mutual fund distribution services

5.1 When you choose to invest through us, we act as an AMFI-registered Mutual Fund Distributor, not as an investment adviser. We may receive commission from the AMCs whose schemes you invest in, as disclosed in the scheme documents and as SEBI and AMFI require.

5.2 Your investments are made with the AMC of each scheme and held in your name. Transactions are subject to KYC, the scheme documents, cut-off times and the rules of the AMC, its registrar and the transaction platform. We are not responsible for delays or rejections caused by them or by incomplete information.

5.3 We never accept cash or payments into a personal account for investments. Payments for investments go directly from your bank account to the mutual fund.

6. Purchases and payments

6.1 Prices are shown in Indian Rupees and include applicable taxes unless stated otherwise. Payments are processed by our payment gateway, Razorpay. We do not see or store your card, UPI or bank credentials.

6.2 Access to paid courses, resources and features is personal to your account and lasts for the period shown at purchase. Refunds and cancellations are governed by our Refund Policy.

7. Our content and your licence

7.1 The Services and their content, including text, study materials, mock tests, designs, software, logos and the "The Financial Vines" name, belong to us or our licensors and are protected by Indian and international law.

7.2 We give you a limited, personal, non-exclusive, non-transferable licence to use the Services for your own non-commercial use. You may not copy, resell, share, upload or distribute our content, or share access to paid material.

7.3 Paid downloads may carry your name, email or order ID as a watermark to deter piracy. Removing or altering watermarks is a breach of these Terms.

8. Your content

8.1 You keep ownership of comments, community posts and other content you submit. You give us a non-exclusive, royalty-free licence to host, display and use it to run the Services.

8.2 You are responsible for your content and must have the right to share it. We may remove content that breaches these Terms or the law.

9. What you must not do

In line with rule 3(1)(b) of the IT Rules, you must not host, display, upload, share or transmit any information that:

  1. belongs to another person and to which you have no right;
  2. is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or relates to or encourages money laundering or gambling;
  3. is harmful to children;
  4. infringes any patent, trademark, copyright or other proprietary right;
  5. deceives or misleads about its origin, or knowingly communicates misinformation or information that is patently false;
  6. impersonates another person;
  7. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or incites any offence;
  8. contains software viruses or any code designed to interrupt, destroy or limit the functionality of any computer resource; or
  9. violates any law in force.

You must also not scrape or bulk-download the Services, bypass login, paywalls or security measures, use bots to post or message, overload our systems, offer stock tips or solicit investments from other users, or use the Services to build a competing product.

10. Third-party services

The Services link to and rely on third parties such as AMC and registrar portals, payment pages, sign-in providers and social media. Their own terms and privacy policies apply, and we are not responsible for their content or practices.

11. Availability and changes to the Services

We work to keep the Services available and accurate but do not guarantee they will be uninterrupted or error-free. We may add, change or withdraw features. If we withdraw a paid product during its access period, our Refund Policy applies.

12. Suspension and termination

12.1 You may close your account at any time by writing to info@thefinancialvines.com.

12.2 If you breach these Terms or the law, we may remove content, suspend or terminate your access, or both. As the IT Rules require, we may do this immediately for serious breaches. Records we must keep by law are retained as set out in our Privacy Policy.

13. Limitation of liability

13.1 To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for investment losses, lost profits or lost data arising from your use of the Services or reliance on any tool, estimate or content.

13.2 Our total liability for any claim relating to the Services is limited to the amount you paid us for the product concerned in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law.

14. Indemnity

You agree to compensate us for losses and reasonable costs arising from your breach of these Terms, your misuse of the Services, or content you submit.

15. Grievances

15.1 Contact our Grievance Officer, Abhishek Jain, Director & CTO, at info@thefinancialvines.com, by post at Plot No 114, Block 5, Phase-5, Sector 53, HSIIDC, Kundli, Sonipat, Haryana 131028, India, or on WhatsApp at +91 98100 43744 (Monday to Friday, 10:00 to 18:00 IST).

15.2 We acknowledge complaints within 24 hours and resolve them within 7 days, as the IT Rules require. Requests to remove unlawful content are resolved within 36 hours, and complaints about content exposing a person's private areas, nudity, sexual acts or impersonation (including morphed images) are acted on within 2 hours.

15.3 If you are not satisfied, you may appeal to the Grievance Appellate Committee at www.gac.gov.in within 30 days of our decision. Personal data complaints may also be taken to the Data Protection Board of India, as our Privacy Policy explains.

16. Mutual fund complaints

16.1 For complaints about a mutual fund transaction or our distribution services, write to us first at info@thefinancialvines.com. You may also contact the AMC concerned or its registrar directly.

16.2 If your complaint is not resolved, you may lodge it with SEBI through SCORES, and then use SEBI's Online Dispute Resolution portal at smartodr.in, as SEBI's rules allow.

17. Changes to these Terms

We may update these Terms to reflect changes in the Services or the law. We will post the new version here with a new effective date and, for material changes, notify you by email or on the website at least 15 days before they take effect, unless the law requires a change sooner. Continuing to use the Services after that date means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of India. Subject to clause 16, the courts at Sonipat, Haryana have exclusive jurisdiction over any dispute arising from these Terms or the Services.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor business. These Terms are available in English, and you can ask for them in any language listed in the Eighth Schedule to the Constitution of India by writing to info@thefinancialvines.com.
